On April 12, 2024, Dynamic Integrated Services (Protestor) filed the above-captioned protest, challenging the Service-Disabled Veteran-Owned Small Business (SDVOSB) status of Aptive Resources LLC (Aptive), the apparent awardee of Solicitation No. 36C10B24Q0130.

The Contracting Officer (CO) forwarded the protest to the U.S. Small Business Administration (SBA) Office of Hearings and Appeals (OHA).2

On April 18, 2024, OHA issued an Order to Show Cause, pointing to deficiencies in the status protest. (OHA’s Order (Apr. 18, 2024).) Protestor was directed to file a response by no later than April 25, 2024, why the status portion of this protest should not be dismissed as nonspecific. (Id.)

On April 19, 2024, Protestor filed a Response to OHA’s Order to Show Cause and stated that its protest was a size protest only, not a challenge to Aptive’s status as a Service-Disabled Veteran-Owned and controlled concern. (Response, at 1.) Protestor agreed that any perceived challenge to Aptive’s veteran-owned status should be dismissed. (Id.)

On April 22, 2024, Aptive filed a Motion to Intervene, and OHA granted the motion on April 25, 2024. On May 1, 2024, Aptive filed a Response to the Order to Show Cause and acknowledges Protestor’s withdraw of its status protest. (Aptive Response at 2.) Aptive further agrees that “the status protest must be dismissed, in accordance with 13 C.F.R. § 134.1005(a)(2)” and “has no objection to dismissal.” (Id.)…
