NIH has publicly posted the decision document challenging the award decision for solicitation No. 140D0424Q0045, requesting proposals to perform IT services

Plaintiff 22nd Century Technologies, Inc. brings this post-award bid protest challenging a decision by the Department of the Interior (“the Agency”), acting on behalf of the National Institutes of Health, not to include it in a set of blanket purchase agreements for information technology (“IT”) services.

Plaintiff argues that the Agency’s review of two aspects of its proposal was arbitrary and capricious.The parties have filed cross-motions for judgment on the administrative record, and I have heard oral argument. For the reasons discussed below, Plaintiff’s motion is GRANTED, and Defendant’s motion is DENIED. The matter is REMANDED to the Agency, and the Agency is ENJOINED as described below.
