More than 4 months after the award was made, the Court of Federal Claims announced this week that they are siding with the Government, denying the challenge related to this Skilled Nursing Facility Value Based Purchasing Validation Program.  This is the lone known active protest.

“Statement of Facts – On October 11, 2023, the United States Department of Health & Human Services, Centers for Medicare & Medicaid Services (the “Agency”) issued Request for Proposal No. 240287 relating to the Agency’s Skilled Nursing Facility Value Based Purchasing Validation Program.

Both Movant and Reli Group, Inc. (“Plaintiff”) responded to that solicitation. Movant submitted its proposal to the Agency on November 13, 2023. On or about January 31, 2024, the Agency awarded the contract to Movant (the “Solicitation”). On February 16, 2024, Plaintiff filed its action (“Complaint”) in this Court. Plaintiff filed its Complaint to challenge the Agency’s award of the Solicitation to Movant. B”
